The Ministry of Land and Resources, the Poverty Alleviation Office of the State Council and the National Energy Administration jointly issued the "Opinions on Supporting Photovoltaic Poverty Alleviation and Regulating the Land for Photovoltaic Power Industry" (Guo Tu Zi Zi [2017] No. 8, hereinafter referred to as "Opinions").

Strengthen the protection of land for photovoltaic poverty alleviation, further refine and regulate the management of land for photovoltaic power generation industry, and effectively strengthen the supervision of land for photovoltaic power generation projects.

The "Opinions on Supporting the Development of New Industries and New Formats and Promoting Mass Entrepreneurship and Innovation in Land Use" issued by the Ministry of Land and Resources and other six departments (Guo Tu Zi Gui [2015] No. 5) once made it clear that photovoltaic power generation projects use Gobi, desert, and grasslands If the unused land is not used, the part of the land that does not occupy land and does not change the surface form can be identified according to the in-situ type, which plays a positive role in promoting the development of the photovoltaic power generation industry.

To deepen the supply-side structural reform, the Ministry of Land and Resources and other three departments jointly issued the "Opinions."

1. If photovoltaic power generation can use unused land, it shall not occupy agricultural land.

2. Those who can make use of inferior land shall not occupy good land.

3. It is forbidden to occupy permanent basic farmland in any way, and it is strictly prohibited to develop photovoltaic power generation projects in areas explicitly prohibited by relevant national laws, regulations and plans.

The "Opinions" make it clear that the photovoltaic power generation projects constructed in the key poverty alleviation areas in deep poverty areas, and the National Energy Administration and the Poverty Alleviation Office of the State Council have determined the land for photovoltaic power generation projects within the construction scale of the national village-level photovoltaic poverty reduction power stations.

With policy support, if the photovoltaic array uses agricultural land other than permanent basic farmland, the nature of the original land may not be changed without damaging agricultural production conditions.

The "Opinions" require that for the construction of photovoltaic composite projects using agricultural land other than permanent basic farmland, the provincial energy and land resources authorities should consult with relevant departments at the same level to propose construction requirements, certification standards, and regulatory measures to avoid affecting agricultural production. .

Among them, the use of arable land other than permanent basic farmland to arrange photovoltaic square arrays should be strictly requested.

The "Opinions" emphasize that the supervision of land use for photovoltaic power generation projects should be strengthened. Except for the circumstances stipulated in the documents, those who harden the ground and destroy the cultivated layer in the land used for photovoltaic power station projects should be investigated and dealt with as illegal land use.

After the installation of the photovoltaic grid, and the projects managed by agricultural land and unused land did not return to the original state when they exited, the local energy authority should clean up or order rectification.

Violation

If the project violates the regulations, the investment entity shall be included in the list of untrustworthy entities in the energy sector and joint disciplinary measures shall be implemented.

The Ministry of Land and Resources will conduct special monitoring on the land used for various types of photovoltaic power station projects according to the needs of industry management.
